Terms of Service — Hengo Accounting Software

1. Acceptance of terms

By creating a Hengo account or using the platform, you agree to these terms of service. If you do not agree, you may not use the platform. If you are accepting these terms on behalf of a business, you represent that you have authority to bind that business.

2. Description of service

Hengo is a multi-currency accounting and bookkeeping platform that provides transaction management, tax calculation (GST, HST, QST, US sales tax, IVA), invoicing, financial reporting, bank reconciliation, and related features for businesses in Canada, the United States, and Costa Rica.

3. Subscription and billing

Hengo offers three subscription plans: Starter ($19/month), Growth ($59/month), and Professional ($119/month). Annual billing is available at a discount. All plans include a 14-day free trial with no credit card required.

Subscriptions are billed in advance on a monthly or annual basis. You can upgrade, downgrade, or cancel at any time. Upgrades take effect immediately; downgrades take effect at the next billing cycle. No refunds are provided for partial billing periods.

Payments are processed by Stripe. By subscribing, you authorize Stripe to charge your payment method for the subscription fees.

4. Acceptable use

You agree not to:

Use Hengo for any illegal or fraudulent purpose
Upload malicious code, viruses, or harmful content
Attempt to access another user's data without authorization
Reverse engineer, decompile, or disassemble the platform
Use the platform to store data unrelated to accounting or bookkeeping
Resell or sublicense access to the platform without written permission
Exceed the transaction or AI parsing limits of your plan

5. Your data and intellectual property

You retain all ownership rights to the data you enter into Hengo. We do not claim ownership of your financial data, transactions, invoices, or documents. You are responsible for the accuracy and legality of the data you enter.

Hengo and its software, design, branding, and features are our intellectual property. You may not copy, modify, or distribute our software without written permission.

6. Tax and compliance disclaimer

Hengo provides tools to help you calculate and track taxes, but Hengo is not a tax advisor or a CPA. Tax calculations are based on the information you provide and the rates configured in the platform. You are responsible for verifying the accuracy of all tax calculations before filing with tax authorities (CRA, IRS, Hacienda).

Hengo does not file taxes on your behalf. You are responsible for submitting all tax returns and payments to the appropriate tax authorities by the applicable deadlines.

7. Service availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance is performed during off-peak hours with advance notice. We are not liable for downtime caused by factors outside our control, including internet outages, third-party service failures, or force majeure events.

8. Limitation of liability

To the maximum extent permitted by law, Hengo is not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or business interruption. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.

9. Termination

You may cancel your subscription at any time. We may suspend or terminate your account if you violate these terms or if your account remains inactive for more than 12 months. Upon termination, your data is retained for 30 days and then permanently deleted.

10. Changes to terms

We may update these terms from time to time. We will notify you of material changes by email or in-app notification at least 30 days before they take effect. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.
